CreatorVersed/IMS Terms of Service

These Terms of Service ("Terms") govern your use of the CreatorVersed platform, including the Influencer Marketing Society ("IMS") job board, newsletter, and related services (collectively, the "Service") operated by Raised Voices LLC ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

CreatorVersed operates as a comprehensive creator economy hiring platform that includes:

• Job Board (IMS): Connecting creator economy professionals with employment opportunities
• Newsletter: Industry insights and career intelligence
• Talent Pool: Database of creator economy professionals and content creators
• Recruitment Services: Internal hiring and external creator partnerships
• Professional Directory: Vetted service providers for creator economy needs

3. User Accounts and Registration

3.1 Account Creation

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of unauthorized use

3.2 Eligibility

4. Job Applications and Talent Pool

Important Notice: By applying to any job posting on our platform, including archived or expired positions, you automatically consent to inclusion in our talent pool. This means:

• Your profile and application materials may be retained indefinitely
• We may contact you about similar opportunities that align with your interests and experience
• Your information may be shared with relevant employers seeking candidates with your background
• You may receive updates about career opportunities, industry insights, and platform features

4.3 Opt-Out Rights

You may opt out of talent pool participation at any time by:

• Using the unsubscribe link in communications
• Updating your preferences in your account settings

5. Employer Services

5.1 Job Postings

Employers using our platform agree to:

• Provide accurate job descriptions and requirements
• Comply with all applicable employment laws
• Treat all candidates fairly and professionally
• Pay agreed-upon fees for services rendered

5.2 Candidate Information

Employers acknowledge that:

• Candidate information is provided for legitimate hiring purposes only
• Personal data must be handled in compliance with applicable privacy laws
• Candidates remain in our talent pool unless they opt out

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you submit but grant us a license to:

• Display and distribute your content through the Service

All platform content, including job postings, industry insights, and proprietary matching algorithms, remains our intellectual property.

9.1 Employer Fees

• All services fees are due upon agreement execution

9.2 No Refund Policy

All fees paid for services are non-refundable, including but not limited to:

• Job posting fees
• Recruitment service fees
• Sponsored partnership fees
• Newsletter sponsorship fees
• Directory listing fees
• Subscription fees

9.3 Sponsored Partnership Credit

While refunds are not provided for sponsored partnerships, we may offer credit toward future services at our sole discretion in cases where:

• Service delivery does not meet agreed-upon specifications
• Technical issues prevent proper campaign execution
• Mutual agreement is reached to modify campaign terms

Any credit offered:

• Must be used within 12 months of issuance
• Is non-transferable and has no cash value
• Applies only to future services with CreatorVersed/IMS
• Expires if account is terminated or closed

9.4 Subscription Services

• Newsletter subscriptions renew automatically
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods or unused subscription time

10. Service Availability

10.1 Platform Access

We strive to maintain continuous service availability but cannot guarantee:

• Uninterrupted access to the platform
• Error-free operation of all features
• Compatibility with all devices or browsers

10.2 Modifications

We reserve the right to:

• Modify or discontinue features with reasonable notice
• Update these Terms as necessary
• Suspend accounts that violate these Terms

11. Disclaimers

• Actions taken by third parties contacted through our platform
• External websites linked from our Service

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount paid for our services in the preceding 12 months

13. Termination
